Non-Disclosure Policy for Low Load HIV Status

In updating a landmark 1998 decision, the Supreme Court now says it is not always a criminal offence for an HIV positive person to keep their status confidential.

The ruling states it’s unlikely HIV can be transmitted if the carrier has a low viral load and a condom is used.  

How is low viral load determined? Should responsibility rely solely on one partner?
